Enroll newly eligible dependents under 26

Since March 23, 2010, group health plans (self-funded and fully insured) that provide dependent coverage have been required to make coverage available to enrollees' adult children until age 26.

 

Grandfathered plans were not previously required to enroll an adult child if he or she was eligible to enroll in a different employer-sponsored plan. However, for plan years beginning on or after Jan. 1, 2014, this exception will no longer apply, and eligible dependents will have to be allowed to enroll regardless of coverage being available through a dependent's employer. Guidance is not clear, but holding an open enrollment period of 30 days or more, is suggested or may be desirable to ensure compliance of this provision of ACA.
