Final Rule Issued on Health Insurance Premium Tax Credit

The Department of Labor, Health and Human Services (HHS) and the Treasury have released a final rule which deals with an issue reserved from a previous version of the rule, defining employer sponsored coverage as affordable as to "related individuals" to an employee if the premium the employee must pay for self-only coverage (the required contribution percentage) does not exceed 9.5 percent of the employee's household income.  This means that even if family coverage is offered but not affordable, dependents will not be eligible for premium tax credits because self-only coverage is deemed affordable.
